General Terms and Conditions.
1. Definitions :
- Client: the natural person or legal entity that commissions PixelGigant, to perform photographic work.
- Photographer: PixelGigant, located at Jan Mahieustraat 1 bus 3, 8800 Roeselare.
- Photographic work: photographic works as referred to in Article 10 of the Copyright Act 1912, as well as all other works according to the law.
- Delivery: the moment when the photographer makes the photographic work available to the client.
- Photoshoot: the planned photographic activities, including any preparations.
- Deposit: the amount of 100 euros paid by the client to the photographer prior to the photoshoot as confirmation of the assignment.

2. Services and Client Responsibility :
- The Client acknowledges and accepts that the successful execution of the photography services depends on the cooperation and responsibility of the Client.
- The Client agrees to provide all necessary information, access, permissions, and cooperation required for the Photographer to properly execute the assignment.

3. Applicability :
- These general terms and conditions apply to all quotations, offers, and agreements between the photographer and the client.
- Deviations from these conditions are only valid if they have been agreed upon in writing between the photographer and the client.
- Quotations and offers are non-binding unless expressly stated otherwise.
- Quotations and offers are based on the information provided by the client, who guarantees its accuracy and completeness.

4. Price and Payment :
- The price for the photographic work is determined based on the quotation or offer from the photographer.
- Payment must be made within 7 days from the invoice date unless otherwise agreed upon in writing.
- In case of late payment, the client is legally in default, and the photographer is entitled to charge statutory interest and collection costs.
- The client must pay a deposit of 50 euros or 100 euros to the photographer as confirmation of the assignment.
- The deposit must be paid within 3 days of issuing the assignment.
- The deposit will be deducted from the total amount of the photoshoot unless the photoshoot is canceled in accordance with these general terms and conditions.
- The Photographer will deliver the photos to the Client within the following timeframes:
- For event photography: within 2 months after receipt of full payment.
- For studio photography: within 2 weeks after receipt of full payment.
- We do not share unedited photos (RAW) and only deliver edited photos.
- The client has the option to purchase additional edited photos at a rate of 15 euros per piece.

5. Consent :
- The client grants the photographer permission to share the captured photos on social media.
- The photographer will use the photos to promote and/or share their work with the public. Typically, we work with clients who do not object to sharing photos online. However, if a client strongly prefers not to have their photos used, they have the option to pay a fee of 100 euros (for small shoots of 1-2 hours) or 300 euros (for shoots longer than 3 hours).

6. Copyright and Use of Photographic Work :
- The copyright of the photographic work always remains with the photographer.
- Upon payment, the client obtains the right to use the photographic work for the agreed purpose and within the agreed timeframe.
- The client is not entitled to modify or reproduce the photographic work without the express consent of the photographer.

7. Liability :
- The photographer is not liable for any damage suffered by the client as a result of the photographic work.
8. Applicable Law :
- Belgian law applies to these general terms and conditions.
- Disputes arising from these general terms and conditions shall be submitted exclusively to the competent court in Belgium.
